Terms and Conditions

1. Scope
These Terms and Conditions apply to the use of the website secondsound.ch ("Platform") and to all contracts concluded between users via the Platform. By registering and using the Platform, the user accepts these Terms and Conditions.
2. Role of Second Sound
Second Sound operates the Platform purely as a mediation service for contact between buyers and sellers of used high-end audio equipment. Second Sound is not itself a party to any transactions concluded via the Platform and does not act as an agent or broker. All purchase contracts are concluded exclusively between the respective users (buyer and seller).
3. Registration and account
Registration is only permitted for persons of legal age. When registering, truthful information must be provided. A user account may not be passed on to third parties. Second Sound reserves the right to block or delete accounts in the event of a breach of these Terms and Conditions or in the case of incorrect information.
4. Listings and seller responsibility
Sellers are responsible for the accuracy and completeness of their listings (condition, description, photos, price, ownership). It is prohibited to offer counterfeit, stolen or unlawfully obtained devices. Each listing is reviewed by Second Sound before publication; however, this review does not include a content-related or legal verification of ownership. Second Sound reserves the right to reject or remove listings without giving reasons.
5. Offer and purchase process
Interested parties can make offers to sellers or choose to buy directly. If the seller accepts an offer, the buyer receives the seller's payment details. Payment is made by direct bank transfer between buyer and seller. Second Sound does not process payments and does not maintain an escrow account. Shipping or handover of the device is arranged exclusively between buyer and seller. Second Sound assumes no responsibility for the proper execution of the transaction.
6. Reviews
After a completed transaction, buyers and sellers can rate each other. Reviews must be truthful and factual. Insulting, untrue or abusive reviews may be removed by Second Sound. Second Sound reserves the right to review ratings on suspicion of abuse.
7. Disclaimer of liability
Second Sound is not liable for damages arising from transactions between users, in particular for non-delivery, defective delivery, non-payment or damage to devices. Second Sound does not guarantee the ownership, condition or authenticity of the listed devices. Liability for slight negligence is excluded to the extent legally permitted.
8. Prohibition and blocking
Second Sound reserves the right to block users and exclude them from the Platform without prior notice in the event of a breach of these Terms and Conditions, repeated negative reviews, suspicion of fraud or abusive behavior. There is no right to reinstatement.
9. Data protection
The processing of personal data takes place in accordance with the separately published privacy policy. By using the Platform, the user consents to the data processing described there.
10. Changes to the Terms and Conditions
Second Sound reserves the right to change these Terms and Conditions at any time. The current version is available on the Platform. In the event of material changes, registered users will be informed by email. Use of the Platform after the changes take effect constitutes consent.
